1. Data controller

2. Scope of data

We process the following data:
a) first name and surname
b) email address
c) telephone number
d) town/city
e) company name
f) activity data (e.g. downloaded Resources)
g) technical data (e.g. IP address)
3. Purposes of processing

We process data for the purpose of:
a) maintaining the User’s account,
b) enabling the use of the Platform and the downloading of Resources,
c) communication relating to the operation of the Platform,
d) enabling contact with Producers whose Resources have been downloaded,
e) handling reports and abuse,
f) ensuring security and analysing the operation of the Platform.
4. Transfer of data to Producers (Platform operating principle)

User data is transferred to a Producer only in the following cases:
a) when their Resource is downloaded, or
b) when registering for an event organised by the Producer or in cooperation with the Producer.

Archispace does not transfer data:
a) without User activity,
b) en masse or independently of the User’s actions.

In the case of Resources made available by Archispace, data is not transferred to Producers.

The scope of data includes, in particular:
a) first name and surname,
b) email address,
c) company name.

The purpose of transferring the data is to enable the Producer to contact the User in connection with a Resource downloaded or presented at an event, and related solutions.

Upon receipt of the data, the Producer becomes a separate data controller.
5. Basis for processing

We process data on the basis of:
a) performance of a contract (use of the Platform), b) Archispace’s legitimate interests (operation of the Platform, communication, security), c) legal obligations (where applicable).
6. Archispace communication
-
In connection with the use of the Platform, Archispace communicates with the User regarding:
a) Resources,
b) events,
c) the Platform’s functionality.
This communication forms part of the use of the Platform.
7. Recipients of data

Data may be transferred:
a) to Producers – exclusively after downloading their Resources or registering for an event organised by the Producer or jointly with the Producer,
b) to providers of IT, hosting and analytical tools,
c) to entities supporting Archispace’s operations (e.g. legal and accounting firms).

User data may be transferred to PROCAD SA, with its registered office at 80-122 Gdańsk, ul. Kartuska 215, VAT No.: 584 10 03 488 (hereinafter: PROCAD) – a partner of Archispace – in connection with cooperation in the following areas:
a) the organisation of educational events (e.g. BIM Academy),
b) the development of users’ design skills,
c) providing access to software and tools for designers.
The transfer of data takes place on the basis of Archispace’s legitimate interest in developing its offering for users and supporting their professional development.
PROCAD acts as a separate data controller.
8. Transfer of data outside the EEA
Data may be transferred outside the European Economic Area in connection with the use of technological tools.
In such cases, appropriate legal safeguards are applied.
9. Retention period

We retain data:
a) for the duration of your account,
b) until it is deleted,
c) for the period required by law,
d) for the time necessary to pursue claims.
Deleting your account does not affect data previously transferred to Manufacturers.
10. Your rights

You have the right to:
a) access your data,
b) rectification,
c) erasure,
d) restriction of processing,
e) objection,
f) data portability,
g) lodge a complaint with a supervisory authority,
h) where data is processed on the basis of a legitimate interest, you have the right to object to such processing, including the transfer of data to PROCAD S.A.
11. Voluntary provision of data
The provision of data is voluntary but necessary to create an account and use the Platform.
Failure to provide data prevents the use of the Resource download function.
12. Data security
We use appropriate technical and organisational measures to protect data.
13. Cookies

The Platform uses cookies:
a) essential – for the website to function,
b) analytical – with the user’s consent.
Consent may be withdrawn at any time.
14. Changes to the policy
The policy may be updated. The current version is available on the Archispace website.
