§1. General provisions

These Terms and Conditions set out the rules for using the Archispace platform available at www.archispace.com (“the Platform”).

The Platform is operated by Archispace, with its registered office in Gdańsk, at 215 Kartuska Street, Tax Identification Number (NIP) 8992458573 (“Archispace”).

The Platform is used for:
a) making Design Resources available,
b) connecting Designers with Manufacturers,
c) promoting the brands and products of manufacturers in the construction industry.

Use of the Platform constitutes acceptance of these Terms and Conditions and the Privacy Policy.
§2. Definitions
User / Designer – a person holding an account on the Platform who is not a Manufacturer publishing on the Platform.
Manufacturer – an entity publishing Resources or an offer.
Resources – digital files (e.g. CAD, BIM), design materials and other content.
Platform – the Archispace service.
§3. Nature of the Platform

Archispace provides access to Resources:
a) made available by Producers,
b) made available directly by Archispace.

Use of the Platform by Users / Designers is free of charge.

The Platform operates under the following model:
a) access to Resources for Designers,
b) the ability for Manufacturers to contact Designers interested in their solutions.

Archispace cooperates with PROCAD SA in organising educational events, including initiatives such as BIM Academy, and in supporting users in accessing software and developing design skills.
§4. User Account

Use of the Platform requires the creation of an account.

Creating an account constitutes the conclusion of a contract with Archispace on the terms described in these Terms and Conditions.

Creating an account is voluntary and results in the User’s acceptance of these Terms and Conditions and the Privacy Policy.

The User undertakes to provide true details, i.e. details consistent with their identity document.

The account enables:
a) downloading Resources,
b) access to events,
c) use of Archispace tools.
§5. Archispace Communication

Creating an account means that Archispace will communicate with the User in connection with the operation of the Platform.

Communication includes, in particular, providing Users with information about:
a) new Resources,
b) events,
c) the Platform’s features and tools,
d) industry news;

Communication forms an integral part of using the Platform and cannot be disabled by the User, who accepts this condition.
§6. Downloading Resources and data transfer

By downloading a Resource made available by a Producer:
a) the User provides their data to that Producer,
b) the User enables the Producer to contact them regarding their products and solutions.

Data is transferred exclusively to the Producer whose Resource has been downloaded.
-
Archispace does not transfer User data to Producers:
a) on a mass scale,
b) regardless of the User’s activity.

In the case of Resources made available by Archispace, data is not transferred to Manufacturers.

If a User registers for an event (e.g. a webinar, training session, workshop) organised by a Manufacturer or in cooperation with a Manufacturer:
a) the User’s data may be transferred to that Manufacturer,
b) to enable participation in the event and contact regarding matters related to it.

The provisions of this paragraph do not preclude the transfer of data in other cases specified in the Privacy Policy.
§7. Producers and the publication of Resources

A Producer may publish Resources on the Platform in accordance with the scope of their subscription, on the basis of a relevant, separate agreement.

By placing Resources on the Platform, the Producer hereby declares that:
a) they hold the rights to the published materials,
b) the materials are lawful,
c) the materials are accurate and up to date.

The Producer bears full responsibility for the published content.
-
Archispace may remove or block Resources that breach the Terms and Conditions, the law or general social norms.
§8. Liability

Archispace shall not be liable for:
a) content published by Producers,
b) the actions of Producers,
c) the manner in which the User utilises the Resources.

Resources are provided ‘as is’, without any warranty as to their completeness, accuracy, timeliness or fitness for a particular purpose.
§9. Licence

The rules for using the Resources available on the Platform are determined by Archispace.

The Resources may be used by the User solely for design purposes, in particular for the development of concepts, documentation and visualisations.

The following is prohibited:
a) making the Resources available to third parties,
b) the sale or commercial distribution of the Resources,
c) using the Resources in a manner contrary to their intended purpose.

Archispace does not transfer copyright in the Resources to the User.

The Resources remain the property of the relevant Producers or Archispace.
-
Archispace does not own the Resources made available by Producers and is not responsible for their content, completeness or suitability.
§10. Reporting abuse

The User may report:
a) incorrect Resources,
b) legal infringements,
c) incorrect information.

Reports should be sent to: archispace@archispace.pl.
§11. Personal data

The rules governing the processing of personal data are set out in the Privacy Policy.

Upon receipt of the data, the Producer becomes a separate controller of that data.
§12. Termination of use of the Platform

The User may delete their account at any time.
-
Archispace may delete a User’s account in the event of a breach of the Terms and Conditions.
-
Failure to accept the following rules:
a) Archispace communications,
b) the transfer of data when downloading Resources,
c) prevents the use of the Platform.

Deletion of an account does not affect data previously provided to Producers.
§13. Amendments to the Terms and Conditions

The Terms and Conditions may be updated.
-
The current version is available on the Platform.
§14. Governing Law
- These Terms and Conditions are governed by Polish law, and the use of the Platform is subject to the jurisdiction of the ordinary courts of the Republic of Poland; unless otherwise excluded by law, exclusive jurisdiction is assigned to the court competent for the registered office of Archispace.
